1. Agreement to these terms
These terms of service (“Terms”) are an agreement between you and the Fouroc group company that provides the service you use (“Fouroc”, “we”, “us” or “our”). They apply to our mobile apps, our websites at fouroc.com and fouroc.in, and any related service that links to them (together, the “services”).
By downloading, accessing or using the services, you agree to these Terms and to our privacy policy. If you do not agree, do not use the services.
2. Who provides the services
Fouroc is a group of companies. Each app is provided by the group company named as the developer or seller on its store listing, which for vuin is Fouroc Softwares. That company is responsible to you for the app. Our websites are provided by Fouroc.
Some apps have additional terms shown in the app. Those terms apply alongside these Terms, and take priority for that app if they conflict.
3. Eligibility
You must be at least 18 years old to use vuin. Access to vuin is by invite and verification, and we may decline or remove access that does not meet our membership criteria.
You may not use the services if you are prohibited from doing so under applicable law.
4. Your account
- Provide accurate information and keep it up to date.
- Keep your login details secure and do not share your account.
- Tell us promptly through our contact form if you think your account has been accessed without permission.
You are responsible for activity under your account, except where it results from our failure to take reasonable security measures. You can delete your account at any time as described on our account deletion page.
5. Licence to use the services
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use our apps on devices you own or control, and to use our websites, for your personal, non-commercial use. For apps from the App Store, this licence is also subject to the Usage Rules in the Apple Media Services Terms and Conditions.
You may not copy, modify, distribute, sell or lease any part of the services, or reverse engineer or attempt to extract their source code, except where the law expressly allows it.
6. Acceptable use
You agree not to:
- break any law, or infringe anyone’s rights, including intellectual property and privacy rights;
- post or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, hateful, sexually explicit, or that exploits or endangers children;
- impersonate anyone or misrepresent your connection with any person or organisation;
- send spam, bulk or unsolicited messages, malware or any code designed to harm or interfere with the services or other people’s devices;
- access the services by automated means, scrape data, or try to bypass security or usage limits;
- interfere with or disrupt the services or the servers and networks connected to them; or
- use the services to build a competing product, or to train machine-learning models, without our written permission.
We have zero tolerance for child sexual abuse and exploitation. See our child safety standards.
7. Purchases, subscriptions and refunds
vuin is free to join and use. If we offer optional paid features in future, prices will be shown in the app before you buy, including any applicable taxes, and these rules apply:
- Billing. Purchases made in apps downloaded from Google Play or the App Store are billed through your Google or Apple account and are subject to that store’s terms.
- Automatic renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. Your account is charged within 24 hours before the end of the current period.
- Cancelling. You can manage or cancel a subscription at any time in your Google Play or Apple account settings. Cancelling stops future renewals; you keep access until the end of the period you have paid for. Deleting the app or your account does not cancel a subscription.
- Free trials. If a free trial is offered, it converts to a paid subscription when it ends unless you cancel before then. Any unused part of a trial is forfeited when you buy a subscription.
- Price changes. We will tell you about price changes in advance, as required by the app store and applicable law.
- Refunds. Refunds for store purchases are handled by Google or Apple under their refund policies. Nothing in these Terms limits any right to a refund you have under consumer protection law.
8. Your content
You keep ownership of content you create or upload in the services (“your content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, display and transmit your content only as needed to operate, secure and improve the services for you. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain in backups for a limited time.
You are responsible for your content and confirm you have the rights needed to share it. Where an app lets users share content, it includes tools to report objectionable content and to block abusive users. We review reports promptly and may remove content or suspend accounts that break these Terms.
9. Our intellectual property
The services, including software, design, text, graphics, logos and the Fouroc and Fouroc Softwares names, are owned by Fouroc or its licensors and are protected by intellectual property laws. These Terms do not give you any right to use our names, logos or trademarks.
If you send us feedback or suggestions, we may use them without obligation to you.
If you believe content in the services infringes your copyright, send a notice through our contact form with enough detail for us to identify the work and the content concerned.
10. Third-party services
The services may link to or integrate with services we do not control, such as app stores, sign-in providers, payment processors and maps. Your use of those services is governed by their own terms and policies, and we are not responsible for them.
11. Additional terms for apps from the Apple App Store
If you downloaded an app from the Apple App Store, you and we acknowledge and agree that:
- These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- We are solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not disclaimed in these Terms.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app, such as your wireless data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Questions, complaints or claims about the app should be directed to us through our support page.
12. Additional terms for apps from Google Play
If you downloaded an app from Google Play, you also agree to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app. In-app purchases are processed by Google Play’s billing system, and refunds are subject to Google Play’s refund policies.
13. Disclaimers
We work hard to keep the services reliable and useful, but they are provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the services will be uninterrupted, error-free or free of harmful components.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
14. Limitation of liability
To the extent permitted by law, Fouroc and its group companies, and their directors, employees and partners, will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or related to your use of the services.
To the extent permitted by law, our total liability for any claim relating to the services is limited to the greater of (a) the amount you paid us for the service in the 12 months before the claim arose, or (b) INR 5,000 (or the equivalent in your local currency).
These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Fouroc and its group companies from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the services. This does not apply if you are a consumer and the law does not allow it.
16. Suspension and termination
You may stop using the services and delete your account at any time.
We may suspend or end your access if you seriously or repeatedly break these Terms, if we are required to by law, or if your use creates a risk of harm to others or to the services. Where reasonable, we will tell you in advance and explain why. If we discontinue a paid service, we will give reasonable notice and, where required, a proportional refund.
Sections that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.
17. Governing law and disputes
These Terms are governed by the laws of India. Before starting any formal proceedings, please contact us through our contact form so we can try to resolve the issue informally. Subject to the next paragraph, the courts of competent jurisdiction in India have exclusive jurisdiction over any dispute.
If you are a consumer living in the European Union, the United Kingdom or another country whose laws give you the right to bring claims in your local courts or to rely on mandatory local consumer protections, nothing in these Terms takes away those rights.
18. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page with a new “Last updated” date and, for material changes, notify you in the app or by email at least 15 days before they take effect, unless the change is required sooner by law or for security. If you continue to use the services after the changes take effect, you accept the updated Terms.
19. General
- These Terms, together with our privacy policy and any app-specific terms, are the entire agreement between you and us about the services.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- If we do not enforce a right, that is not a waiver of it.
- You may not transfer your rights under these Terms. We may transfer ours to another Fouroc group company or as part of a business reorganisation, provided your rights are not reduced.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
